Decree No. (78) of 2005 to form the Board of Directors of the National Oil and Gas Authority and determine its purposes and competences

​We are Hamad bin Isa Al Khalifa, King of Bahrain.
After reading the Constitution,

On the Royal Decree No. (38) of 2003 establishing the Natural Gas Commission,

On Decree No. (63) of 2005 establishing the NationalOil and Gas Authority,

After the approval of the Council of Ministers,

At the prime minister's presentation,

 

We draw the following:

Article (1)

The NationalOil and Gas Authority is the competent authority for all matters related tooil and gas in the Kingdom.

The Authority aims to preserve the kingdom's wealth ofoil and natural gas and find alternatives to them to ensure the best utilization of these wealth and achieve the largest return from it.

 

Article (2)

In order to achieve its objectives directly, the Commission has all the necessary actions, in particular the following:

1- Proposing and implementing the policy onoil and gas.

2- Supervising companies and institutions working in the field ofoil and natural gas industry and developing related industries.

3. Conduct studies and research on the Kingdom'soil and natural gas resources and the means to extend the life of their reserves and the means to make the best use of these resources and develop the appropriate pricing policy for them and the use of global advisory offices.

4- Consider strategic options to meetthe Kingdom's oil and gas needs, including the establishment of a holding company that owns all government shares in companies operating in theoil and gas sector and the necessary adjustments.

5- Conducting contacts and negotiations inside and outside the Kingdom on exploiting the kingdom's wealth ofoil and natural gas, and meeting their needs.

6- Development of human and technical devices in the field of energy in the country.

7. Commissioning experienced and competent persons to prepare studies and research on subjects that fall within their respective jurisdictions.

8- Establishing and establishing companies working in the field ofoil and natural gas industry, and supervising them.

9. Establishing the state's participation in the establishment of companies that engage in work that falls within their competences or cooperate sought to achieve their purposes.

10- Recognition of state ownership of companies engaged in the field ofoil and gas, reorganization, participation in it and representation of the state in the general assemblies of these companies.

11. Inspection and inspection of oil tanker tanks and control of the quantities of crudeoil extracted from bahrain fields as well as imported from them.

12- Organizing and controlling the filling, trading, transporting and storage of LPG cylinders, inspecting fuel stations and taking the necessary legal measures in the event of irregularities.

13- Organizing conferences, exhibitions and seminarsandpromoting investment inoilprojects to contribute to the development and growth of theoil and gassector.

Article (3)

The Board of Directors of the NationalOil and Gas Authority is chaired by Dr. Abdul Hussein Ali Mirza, Minister of State and Chairman of the NationalOil and Gas Authority and membership of:

1- Mr. Rashid Mohammed Al-Maraj.

2- Dr. Sheikh Mohammed bin Khalifa Al Khalifa.

3- Dr. Mustafa Ali Mohammed Al Sayed.

4- Mr. AbdulRahman Abdul Hussein Jawahery.

5- Mr. Ahmed Saleh al-Nuaimi.

6- Mr. Majid Abu al-Qasim Shaa'a.

The term of the Board of Directors is three years and renewable for other similar periods.

The remuneration of board members is determined by a decision of the Chairman of the Board of Directors.

 

Article (4)

The Board of Directors of the Authority shall draw up an internal regulation to organize its work and meetings and distribute the competences and responsibilities among its members.

TheBoard of Directors may entrust a person, or form committees among its members or others, to perform specific tasks to assist him in the study of his or her subjects.

 

Article (5)

The Board of Directors of the Authority is the highest authority in the clear, and specializes in the development of its public policies, and the management of its affairs, and the adoption of the main plans related to its implementation, and the follow-up and evaluation of the performance of the Commission of its tasks, and has the right to take what it deems necessary to carry out its tasks and achieve its purposes stipulated in this decree, and may delegate its president in some of these termsof.

Article (6)

The Board of Directors of the Authority issues internal regulations, regulations and decisions related to administrative, financial and technical affairs of the authority, and establishes the organizational structure of its employees and the functional system of its employees, after the approval of the Prime Minister.

TheBoard of Directors of the Authority has all the powers and take all necessary measures to manage the authority and organize its work and achieve its purposes.

The Authority has the capacity to use the best local and international competencies without complying with the provisions of civil service regulations or the limits of financial treatment for its employees and experts.

 

Article (7)

The Chairman of the Board of Directors of the Authority shall be responsible for overseeing the affairs of the Authority, and to determine the proper functioning of the board of directors.

The Chairman of the Board of Directors may delegate other members of theBoard in some of its terms of reference.

 

Article (8)

The Authority shall have financial accreditation within the general budget of the state.

B. The financial year of the Authority begins at the beginning of the state fiscal year and ends at the end of the year.

C. The Authority's resources consist of:

1. The financial allocation allocated to it in the state budget.

2. Donations and subsidies - conditional and unconditional - accepted by the Board of Directors.

3- What companies working in theoil and gas sector may contribute.

D- The authority's funds are considered in the judgment of public funds in the application of the provisions of the Penal Code.

 

Article (9)

The ministries, institutions and agencies concerned in the Kingdom should cooperate with the Authority and provide it with the data, information and studies necessary for its work.

Article (10)

Until the regulations and regulations stipulated in this decree are issued, theBoard of Directors of the Authority shall issue the necessary decisions to conduct its work.

Article (11)

Royal Decree No. (38) of 2003 is repealed by establishing the Natural Gas Commission.

Article (12)

The Prime Minister and the Ministers must implement the provisions of this decree, and it shall be implemented from the date of its issuance, and it shall be published in the Official Gazette.
